here's the situation,

borrowers applied for loan mod last Sept 2009

house put on market for short sale Nov 2009

first offer fell thru - March 2010

multiple calls, faxes to Ocwen requesting HAFA

another offer to purchase - August 2010

package submitted with HAFA RASS form to Ocwen

     (HUD included $3000 relocation money)

last week - short sale approval or offer & HUD EXCEPT no full release of liability (all other HAFA addenda attached to approval letter, e.g. arms length transaction)

 

Ocwen is saying borrower doesn't qualify for HAFA (full release) because

the borrower submitted an incomplete pachage for the loan mod (borrower has copies of everything submitted)

 

as it happens, the Court ordered mediation so I woulnd up talking to the foreclosure attorney who insisted that HAMP application has to be made AFTER April 1st -

 

Anyone ever run into a servicer or attorney interpreting the HAFA guidelines that the loan mod app must be AFTER April 1st?
