They only contact the last person to contact them. What would worry me is that your agent has been in contact with the bank on a loan she really has no permission to be getting information on. This is private, personal information for the seller. It sounds like your agent called for info and is now the contact on that file. The whole, "will contact me if she needs any more docs" or whatever means that the negotiator thinks she is talking with the seller's side.

This is why it is so important for only one person to be in communication with the bank.

I hope it all works out for you, but your agent has no business contacting the seller's lender for personal, financial information...which is exactly what is happening, and is in violation if the seller did not give written permission for your agent to do so...I sure hope that YOUR agent was forwarding a message from the SELLER's agent and not that your agent is in contact with the bank...pushing whoever was previously in contact with the bank out of the way. That does not sound good, at all.

That $3,000 is what WF is willing to give to the 2nd. That is not exactly indicative of what BofA will accept.

Again, there is just no way for me to answer this question. You said the pay off would be around $171k, but how much was the total loan for the 2nd? If it's a small 2nd, they may just do it faster. If it's a big loss ($50k in losses, etc) then they may not. If it's a HELOC (Home Equity Line of Credit) they may not...or they may come back and demand more money.

There are just too many variables for me to say yes they will come back fast or no they won't.

There is no way for me to say anything either way. Them accepting this is all dependent upon a bunch of factors. If they've already verbally accepted this, then it shouldn't take too long to get an approval back. But, if they did not accept this, then there is no way to say.
