Andy Stetz said… It is amazing what lengths BOA will go to to not close a short sale. I am the selling agent on a FHA preforeclosure. Our docs are sitting at title and BOA assigned a new negotiator 2 days prior to settlement. The negotiator cannot find the file but says when she finds it she needs 5 days to review it. The file was already reviewed and approved by the prior negotiator. The supervisor cannot find the file. No one seems to have the ability to help. The listing agent and I have both filed complaints with HUD. BOA is only interested in one thing and it is not closing short sales. Here is the most common scenerio I see repeated. BOA starts the client into HAMP, tells borrower that they cannot qualify if they are current on payments, borrower stops making payments, several months later borrower is denied HAMP on debt to income and required to make up late payments with penalties and interest or face foreclosure(propagated by BOA telling client not to make payments to qualify for HAMP), panic sets in and borrower contacts helpful local real estate agent(who will not make a dime on the transaction) to find out about short sale. Agent initiates a HAFA short sale. BOA moves file to a third party (DTS, AMS, REDC) and the client is contacted and offered a COOP short sale and is told it is similar to HAFA but much faster. Client accepts COOP and is then offered a DIL with wavier of a deficiency judgement. BOA then collects the mortgage insurance and has eliminated the cost of a lengthy foreclosure. The whole process takes about 60 to 90 days after the Coop is accepted. And that is what BOA is interested in. Not short sales. It is all about the money. Not about the client.
