Attempting to process a short sale with HSBC (beneficial finance). The owners went thru a bankruptcy and there was a $12.5K judgment from HFCIII that was included in the bankruptcy. after the bankruptcy was completed the collection agency (a law firm) filed another judgment for the $12.5K. If you try to contact HFCIII you will be sent into on hold with crappy music never never land. I went through the law firm and they are saying that they will grant a partial release to complete the short sale. I am telling them and Beneficial that the partial release won't fly as my clients are on a fixed income, living with a brother in law, and would be better to go to foreclosure than to accept a partial release. The judgment according to the BR attorney is uncollectable since the personal liability was released by the bankruptcy. I am questioning the validity of the judgment. Any thoughts.
