I have done quite a few shortsales the "old fashion" way. I am working on my forst presale HAFA shortsale. I have the SSA and I am trying to find out about one form that was included in the package. It is called and AFFIDAVIT OF OCCUPANCY. I can not seem to find this anywhere in HAFA documents. The SSA agreement came on the lenders letterhead just as this form did.

 

The homeowner is occupying the property and will until the process is complete. However she bought a contract for deed during the time that we started the process and the time we recieved the SSA. The affidavit states that the homeowner certifies that have not entered into a an agreement to purchase a 1-4 dwelling unit PRIOR to HAFA evaluation and will not until the HAFA agreement has been completed.

 

Can the lender add thier own extra agreements to the SSA or is this not acceptable. I can not seem to find an answer anywhere to this.
