This difficult and convoluted to explain so I will try to be brief. I received a counter offer from B of A which the buyer accepted, it included a $3000.00 pay out to the 2nd lien. I had a letter (included in the offer paperwork) of release from the 2nd for that amount. The negotiator came back with another counter offering the 2nd $8500.00 and demanding the buyer pay $2000.00 more than the previous counter.

I wrote back that I was confused about why they would do this, and wonder of wonders the negotiator called me. He told me it was B of A's policy to pay 8.5% of the 2nd but he would OK the $3000.00 payout if the buyer would pay $2000.00 more. The more we talked the less it made sense and he just kept saying this is a negotiation...my response was, Why would you send me a counter offer you couldn't honor...this is a negotiation...why....etc, etc. He finally emailed me a net he would accept but he would not put it into equator.

I feel like I am in wonderland. So two questions:

1. Has anyone heard of this kind of exchange?

 

2. If they get their bottom line buy having the buyer increase the price has anyone had any success getting them to pay for the HOA doc prep fees? This buyer is low on cash for the closing costs above the 3% they are getting, but they have been able to pay $2000.00 more to make the B of A demand work.

 

Any suggestions would be helpful. I have to answer this today. July 1.
