After receiving approval on my Wells Fargo Short Sale, we were instructed in the Approval letter to have the settlement officer forward a copy of the HUD 1 48 hrs. prior to closing. She did, only to receive an e-mail response back stating that the "file is not currently active and the contract was rescinded" a week before, after we had received the approval. Upon multiple discussions with Liquidations, it turns out the Closer had sent the closing documents to the WRONG REALTOR. The sellers had been working with a realtor prior to me, and his contact info was still in their system. After contacting him and he told them he wasn't working on that file, the closer went ahead and closed the file or "rescinded our contract," instead of looking in the file's notes where she would've seen I am the realtor who's been working on this short sale since May! Since it was an internal error, I was hoping to have the supervisor of the closer deal with the error and reactivate the file so we can close. However, after multiple e-mails to the closer, her supervisor, and the negotiator who was assigned to the file, no one has responded. It's been a week.
My question is: what's the next step I should take? Should I resubmit the entire file and wait for it to be assigned to another negotiator and go through all of that again? If I do that, I'm worried the foreclosure sale date of 12/8 will come before our settlement takes place, at the rate of communication I've received from Wells Fargo and all will be in vain.
